TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of Kudo, a mobile application operated by Ajhel Amanonce and Jacen Salvador, doing business as mthdstudios (“mthdstudios,” “we,” “us,” or “our”). Kudo helps users scan, review, rank, and organize packaged grocery foods (the “Service”).
By creating an account or using Kudo, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Kudo.

1. Eligibility
You must be at least 13 years old to use Kudo. If you are under the age of legal majority where you live, a parent or legal guardian must agree to these Terms on your behalf.
You may not use Kudo if doing so would violate applicable law or if we previously suspended or terminated your access for violating these Terms.
2. Accounts
You may sign in using an eligible Apple or Google account. You are responsible for maintaining the security of your account and for activity performed through it. Notify us promptly if you believe your account has been compromised.
Provide accurate information and do not impersonate another person, create accounts deceptively, or transfer your account without permission.
You may delete your account from Kudo’s settings. Account deletion does not cancel an active App Store subscription.
3. Kudo Content and Food Information
Kudo provides product information, nutrition information, community ratings, reviews, rankings, and personalized organization tools. Some information comes from users or third-party data sources and may be incomplete, outdated, or incorrect.
Kudo is not a medical, nutrition, allergy, or dietary-safety service. Do not rely on Kudo as the sole source for allergen, ingredient, nutrition, health, or safety decisions. Always inspect the product packaging and consult a qualified professional when appropriate.
Ratings, scores, rankings, and recommendations are opinions or automated summaries, not guarantees of product quality, safety, or suitability.
AI-generated taste checks
Kudo’s “Kudo says” taste checks are generated by a third-party generative AI service that summarizes publicly available opinions about how a product tastes. These summaries are clearly labeled as AI-generated in the app.
AI-generated output may be inaccurate, incomplete, outdated, biased, or attributed to the wrong product or flavor. It is not mthdstudios’s opinion, is not a Kudo community review, is not verified by us, and is not an endorsement of any product, brand, or linked source. Linked sources are third-party material we do not control or vouch for.
AI taste checks describe taste and texture only. They are not health, nutrition, allergy, dietary, or safety advice, and the disclaimers above apply to them in full. Do not rely on an AI taste check when making a purchase, dietary, or safety decision—read the product packaging.
Some AI features may be limited by plan, by a periodic allowance, or by usage limits, and those limits may change.
4. User Content
“User Content” includes reviews, ratings, profile information, photos, product submissions, corrections, reports, and other material you submit through Kudo.
You retain ownership of your User Content. You grant mthdstudios a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, format, display, distribute, and otherwise use your User Content as reasonably necessary to operate, improve, promote, and protect Kudo. This license ends when the content is deleted from our active systems, except where continued retention is technically necessary, legally required, or where content has been aggregated or de-identified.
You represent that you have the rights necessary to submit your User Content and grant this license.
5. Community and Safety Rules
You may not submit or use Kudo to distribute content that:
- Is unlawful, fraudulent, deceptive, defamatory, or infringes another person’s rights
- Contains threats, harassment, hate speech, bullying, or targeted abuse
- Is sexually explicit, exploitative, or otherwise inappropriate for Kudo
- Promotes violence, self-harm, dangerous activity, or illegal products
- Contains malware, spam, unauthorized advertising, or manipulated engagement
- Reveals another person’s private information without permission
- Impersonates another person or misrepresents its source
- Intentionally provides false or dangerous product, allergen, or nutrition information
Kudo includes tools to report content and block reviewers. We may review, restrict, remove, or preserve User Content and may warn, suspend, or terminate accounts when reasonably necessary to enforce these Terms, protect users, or comply with law.

6. Subscriptions and Purchases
Kudo may offer optional auto-renewable subscriptions that unlock features described on the purchase screen.
- Payment is charged to your Apple Account when you confirm a purchase.
- The subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period.
- Your Apple Account may be charged for renewal within 24 hours before the end of the current billing period.
- You can manage or cancel your subscription in your Apple Account subscription settings.
- Any free trial or introductory offer is governed by the terms displayed when you subscribe.
- Deleting Kudo or deleting your Kudo account does not cancel a subscription.
- Purchases may be restored using the Restore Purchases option in Kudo.
Prices and billing periods are displayed before purchase and may vary by region. Apple processes payments, refunds, and subscription billing under its applicable terms and policies. Except where required by law or Apple’s policies, mthdstudios does not issue refunds for App Store purchases.
Apple’s Standard End User License Agreement also applies to your use of Kudo and is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
7. Acceptable Use
You may not:
- Access or use Kudo in violation of law
- Probe, disrupt, overload, or bypass Kudo’s security or access controls
- Scrape, harvest, or use automated means to collect Kudo data without permission
- Reverse engineer Kudo except where applicable law expressly permits it
- Use Kudo to develop or train a competing product using unauthorized access to the Service
- Manipulate ratings, reviews, referrals, rankings, subscriptions, or product data
- Upload malicious code or interfere with another person’s use of Kudo
8. Intellectual Property
Kudo, excluding User Content and third-party product information, including its software, design, branding, and original content, is owned by mthdstudios or its licensors and is protected by applicable intellectual-property laws.
These Terms give you a limited, personal, non-exclusive, non-transferable, revocable license to use Kudo for its intended purposes. They do not transfer ownership of Kudo or its intellectual property to you.
9. Third-Party Services
Kudo relies on third-party services for authentication, product data, hosting, analytics, diagnostics, notifications, and purchases. Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
10. Changes to Kudo
We may add, change, suspend, or discontinue features. We may release updates needed for security, compatibility, legal compliance, or continued operation. We do not guarantee that every feature or third-party product record will always remain available.
11. Suspension and Termination
You may stop using Kudo or delete your account at any time.
We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or harm, or exposed us or others to legal liability. Where appropriate, we may provide notice or an opportunity to appeal by contacting support.
Sections that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, and dispute terms—will survive.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUDO IS PROVIDED “AS IS” AND “AS AVAILABLE.” MTHDSTUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
WE DO NOT WARRANT THAT PRODUCT DATA, USER CONTENT, SCORES, NUTRITION INFORMATION, INGREDIENT INFORMATION, OR RECOMMENDATIONS ARE COMPLETE, ACCURATE, SAFE, OR SUITABLE FOR YOUR NEEDS.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MTHDSTUDIOS AND ITS OWNERS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM KUDO.
OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO KUDO WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO MTHDSTUDIOS THROUGH KUDO DURING THE 12 MONTHS BEFORE THE CLAIM OR US$100.
Nothing in these Terms limits liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold mthdstudios harmless from third-party claims arising from your unlawful use of Kudo, your User Content, or your material violation of these Terms. This obligation does not apply where prohibited by law.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not subject to a legally required alternative forum will be brought in the state or federal courts located in California, and you consent to their jurisdiction.
Nothing in these Terms removes consumer rights or legal protections that cannot be waived under the laws where you live.
16. Changes to These Terms
We may update these Terms to reflect changes to Kudo, our practices, or applicable law. We will update the date above and provide additional notice when legally required. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
17. General
If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or transfer of Kudo.
These Terms, the Privacy Policy, and any purchase terms shown in Kudo form the agreement between you and mthdstudios regarding the Service.
